1. Acceptance of These Terms

By creating an account, accessing GAPSOE AI or using any part of the service, you agree to these Terms of Service and our Privacy Policy. If you use GAPSOE AI on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, do not use the service.

2. Eligibility

You must be legally capable of entering into a binding agreement and, when using GAPSOE AI for a business, authorized to act for that business. GAPSOE AI is not intended for personal account registration by children.

3. Accounts and Security

You are responsible for providing accurate account information and for keeping login credentials, API keys, integration credentials and other access methods secure. You are responsible for activity performed through your account except to the extent caused by our failure to use reasonable security measures.

You must notify us promptly if you believe an account or credential has been compromised.

4. The GAPSOE AI Service

GAPSOE AI may provide features including AI agents, website chat widgets, knowledge bases, customer conversations, leads, automation, integrations, analytics, team management, billing tools and communication features.

Features may be added, changed, limited or discontinued over time. Some features depend on third-party providers, customer configuration, compatible devices, external APIs or separate provider accounts.

5. Artificial Intelligence and Generated Output

GAPSOE AI uses artificial intelligence systems that can generate text, answers, classifications, summaries and other outputs. AI output can be inaccurate, incomplete, outdated or unsuitable for a specific purpose.

You are responsible for configuring agents, knowledge sources, instructions, tools and escalation rules in a manner appropriate for your business.

6. Customer Content and Data

As between you and GAPSOE AI, you retain ownership of content and data that you upload, connect or submit to the service, subject to the rights needed for us to operate the platform.

You grant GAPSOE AI a limited right to host, process, transmit, reproduce and otherwise use customer content only as necessary to provide, secure, maintain and support the service and as otherwise permitted by these Terms and our Privacy Policy.

You represent that you have all rights, permissions and lawful bases required to process customer content, end-user messages, contact information, websites, documents and connected-system data through GAPSOE AI.

7. Acceptable Use

• Do not use GAPSOE AI to break applicable laws or regulations.
• Do not violate privacy, intellectual property or other rights of another person.
• Do not send unlawful spam, phishing, deceptive or abusive communications.
• Do not distribute malware, malicious code or instructions intended to compromise systems.
• Do not attempt unauthorized access to accounts, systems, networks or data.
• Do not misrepresent identity, authorization or affiliation in a harmful or deceptive manner.
• Do not use integrations or communication channels in violation of the applicable provider's rules.
• Do not interfere with, overload, reverse engineer or bypass security controls of the service except where applicable law expressly permits it.

We may apply reasonable usage, rate, security or abuse controls to protect the service and other users.

8. Third-Party Services and Integrations

GAPSOE AI can connect with third-party services such as identity providers, messaging platforms, AI providers, payment services, email or SMS providers, websites and customer-selected APIs.

Third-party services are governed by their own terms and privacy practices. We are not responsible for a third party's independent acts, availability, changes, suspensions or data practices.

You are responsible for maintaining any third-party account, permission, subscription or credential required for an integration you enable.

9. Free Trials, Plans, Billing and Cancellation

GAPSOE AI may offer free trials, free plans, paid subscriptions, usage-based services or add-ons. Applicable pricing, limits and billing terms are shown in the platform, checkout flow, order form or other commercial agreement.

Unless otherwise stated at purchase, paid subscriptions may renew automatically for the applicable billing period until cancelled. You authorize the applicable payment provider to charge amounts that become due.

Trial access may end automatically when the trial period expires. Features may be limited, suspended or converted according to the plan selected and current subscription status.

Refund eligibility, if any, is determined by the terms shown at purchase and applicable law.

10. Intellectual Property

GAPSOE AI, its software, user interface, branding, documentation and platform technology are owned by or licensed to the operator of GAPSOE AI and are protected by applicable intellectual-property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the service during your valid subscription or permitted access period.

Feedback you voluntarily provide may be used to improve GAPSOE AI without an obligation to compensate you, provided we do not publicly identify you as the source without permission.

11. Privacy and Data Protection

Our processing of personal information is described in the GAPSOE AI Privacy Policy.

If you use GAPSOE AI to process personal information on behalf of your customers or end users, you are responsible for providing required notices, obtaining required permissions or consent, responding to data-subject requests where you are responsible for doing so, and complying with applicable privacy laws.

12. Suspension and Termination

You may stop using GAPSOE AI at any time. Account cancellation or subscription cancellation may be available through the platform or by contacting support.

We may suspend or restrict access when reasonably necessary to address security risk, non-payment, unlawful use, material breach of these Terms, abuse of the service or risks to GAPSOE AI, our providers, customers or third parties.

Where reasonably practicable, we will attempt to provide notice before a non-emergency suspension.

13. Service Disclaimers

To the maximum extent permitted by law, GAPSOE AI is provided on an "as available" and "as is" basis. We do not guarantee uninterrupted operation, error-free output, permanent availability of third-party integrations, or that AI-generated content will be accurate or fit for every purpose.

Nothing in these Terms excludes warranties, rights or remedies that cannot legally be excluded.

14. Limitation of Liability

To the maximum extent permitted by applicable law, GAPSOE AI and its operators, affiliates and service providers will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, business opportunities, goodwill or data arising from use of the service.

Where liability cannot be excluded, any limitation will apply only to the maximum extent permitted by law. Nothing in these Terms limits liability that applicable law does not permit to be limited.

15. Changes to These Terms

We may update these Terms to reflect service changes, legal requirements or business practices. The current version will be posted on this page with an updated effective date. Material changes may also be communicated through the platform or another reasonable method.

Continued use of GAPSOE AI after updated Terms take effect constitutes acceptance of the updated Terms to the extent permitted by law.
